Former ACN Chairman institute court action against INEC, APC over DPP inclusion in merger

A court action has been instituted against All Progressive Congress (APC), Prophet Jones Ode Erue, Sir Olisaemeka Akamukali and Independent National Electoral Commission, by the former Chairman of the erstwhile Action Congress of Nigeria (ACN), in Ethiope East Local Government Area, Mr. Erubu Siakpebru in the Warri Federal High Court, over the inclusion of the 2nd and 3rd Defendants into APC mainstream activities, saying that both Defendants are not part of the merger.
The plaintiff, Mr. Erubu Siakpebru in suit No FHC/WR/CS/12/14 has asked for the following prayers against the Defendants: A declaration that the 2nd Defendants, not qualified and not a member of All Progressive Congress as at when he was made a Chairman of Interim Committee of All Progressive Congress, Delta State Chapter and 3rd Defendants not qualified and not a member of All Progressive Congress as at when he was made the National Auditor of National Interim Committee of APC.
He has also sought an order, directing the 1st Defendant to convene a meeting to elect an interim committee made up of former members of Action Congress of Nigeria, Congress of Progressive Change and All Nigeria Peoples Party and to drop the 3rd Defendant from the National Interim Committee, comprising former members of Action Congress of Nigeria, Congress of Progressive Change and All Nigeria Peoples Party, only before the registration of new members.
The Plaintiff also prayed the court to give an order of perpetual injunction, restraining the 2nd Defendant from further parading himself as Chairman of Interim Committee of 1st Defendant on the basis election/selection held on the 3rd of January 2014 and also restrain the 3rd Defendant from parading himself as Interim National Auditor of 1st  Defendant.
The Plaintiff has also prayed the court for an order of injunction, restraining the 3rd Defendant from recognizing and / having dealings with the 2nd Defendant as Chairman Interim Committee of 1st Defendant in Delta State on the basis of election/selection held on the 3rd   day of January, 2014.
Siakpebru in his summon, had averred that on the 18th of April, 2013, Chief Adolor Okotie-Eboh led the Delta State ACN to Lagos for the convention, explaining that, at the convention, Chief Bisi Akande, Chief Bola Tinubu led the ACN, Chief Ogbonnaya Onoh, Mallam Ibrahim Shekaran led the ANPP, while retired Gen. Buhari Mohammandu led the CPC. He stressed that there was no time that the Democratic People’s Party (DPP), was part of the merger parties, adding that, on the 3rd of January, 2014, Chief Tom Ikimi National leader of the Party, together with the 3rd Defendant who is a member of DPP, inaugurated the Delta State Interim Committee of APC and appointed 2nd Defendant, another DPP member as Chairman of Delta State Interim Committee when both are not part of the merger.
